Colors may appear differently when printed on surfaces like metal, wood, rubber, or plastic compared to paper. Clients are encouraged to submit vector graphics in AI, EPS, or PS formats. Specialty fonts must be outlined, or font files should be provided; otherwise, CustomUSBmemory reserves the right to substitute fonts. Review and carefully check all digital and physical proofs. Digital proofs are not for color verification as screen views may vary. They should confirm size, scale, positioning, spelling, etc. For precise color matching, a physical proof is recommended. PMS color swatches can be obtained from PANTONE's website. Physical proofs accurately represent the color on the final product, but there might be slight variations in the production run. Requesting additional changes or proofs may incur fees and delays. If proof approval is delayed, the order delivery date may be affected. Contact customer service promptly for expedited orders.

UPLOADS

Customers are responsible for verifying all files and folders uploaded to our site for data corruption or errors that may occur during the transfer process. We cannot accept responsibility for errors or data corruption during file transfer. Once files are uploaded to our FTP site, our sole responsibility is to confirm the number of files or folders, file types, and overall size of the data upload as per the customer's instructions. Please ensure the integrity of your files before and after the transfer process.

APPROVAL

CustomUSBmemory will commence production of any order only after receiving approval of the invoice, digital samples, and other service requests, along with the receipt of payment. Any products, services, or discounts not specified on the invoice will not be provided. It's essential to approve all necessary details and fulfill payment requirements to initiate the production process.

PAYMENT

CustomUSBmemory accepts payments through credit cards, wire/money transfers, and purchase orders from approved companies. Production of orders will only commence upon receipt of full payment or a valid purchase order. It is crucial that credit card billing and shipping information match, or an alternate shipping address must be on file with the credit card company to avoid delays. Accounts that are past due and placed into collection are responsible for associated fees and will incur a monthly compounded interest of 1.5% on the outstanding balance. Timely payment is essential to avoid additional charges and ensure smooth order processing.

PRICE

Quoted prices are subject to change without prior notice. To secure pricing, a valid form of payment and approval of the final invoice must be provided, and no items may be removed from the order at that point. CustomUSBmemory offers price matching with any competitor pricing, given a valid quote is presented, and the competitor quote is not below CustomUSBmemory's cost. It's important to note that additional fees may apply to artwork after order approval, depending on the final color count, position, size, etc., of the artwork. Transparency and clear communication regarding pricing adjustments are part of our commitment to customer satisfaction.

RETURN POLICY

CustomUSBmemory provides a lifetime replacement warranty. All returns require a valid Return Merchandise Authorization (RMA) number. It's important to note that CustomUSBmemory will not issue refunds for any custom products or services if the job is produced according to the client's artwork and specifications. The lifetime replacement warranty ensures ongoing support for the products provided by CustomUSBmemory.

INDEMNIFICATION AGREEMENT

By using the services of CustomUSBmemory.com, you agree to indemnify, defend, and hold harmless CustomUSBmemory.com, its affiliates, subsidiaries, officers, directors, employees, agents, licensors, and suppliers (collectively referred to as the "Service Providers") from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees. This indemnification extends to any consequences arising from the use and distribution of any products or services purchased through CustomUSBmemory.com.

LIMITATION OF LIABILITY

Comtread Inc. doing business as CustomUSBmemory.com shall not be liable for any special or consequential damages arising from the use of, or the inability to use, the materials on this site or the performance of the products, even if Comtread Inc. d.b.a CustomUSBmemory.com has been advised of the possibility of such damages. This limitation extends to any potential adverse outcomes related to the use or performance of the products offered.

SHIPPING POLICY

CustomUSBmemory includes UPS Ground shipping service free of charge, but all other delivery methods will be billed as a separate line item on the invoice. It's important to note that CustomUSBmemory will not be held responsible for delays in order delivery caused by any shipping provider. Furthermore, you agree to cover all charges associated with package interceptions and destination changes. Artwork Usage: CustomUSBmemory.com reserves the right to utilize client artwork for illustration and advertisement purposes unless directed otherwise by the client. Jurisdiction and venue for legal proceedings related to this site shall be in state or federal courts located in Florida. Any claim or cause of action must be commenced within one (1) year after it arises.

Waiver and Modification: CustomUSBmemory's failure to insist on strict performance of any provision does not constitute a waiver of that provision. These terms may only be modified by written agreement between CustomUSBmemory.com and the customer. Assignment: CustomUSBmemory.com may assign its rights and duties under this Agreement to any party at any time without notice to the customer. Entire Agreement: These terms and conditions, along with an invoice regarding the products ordered, constitute the complete and exclusive agreement between CustomUSBmemory.com and the customer. They supersede all prior or contemporaneous proposals, understandings, representations, and communications relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
